Terms and Conditions

These are the Terms and Conditions for the provision of sleep consulting services by Catherine
Patel - trading as Lullaby Baby Sleep (“LBS”) - to the Client.

Definitions


“Assessment” refers to the Sleep Consultant’s review and analysis of information
provided by the Client, including in the Pre-consultation Form, Sleep Log, and ad hoc
feedback, to identify challenges and develop tailored recommendations supporting the
child’s sleep and the family’s objectives.


“Booking Form” refers to the document provided to the Client for completion. It
requires the Client to enter their personal details and select the Service Package they
wish to purchase. Submission of the Booking Form confirms the Client’s intention to
proceed with the chosen service.


“Client” refers to the individual or individuals who engage LBS’s services, provide the
necessary information, and agree to these Terms for the purpose of improving their
child’s sleep.


“Consultation” refers to the dedicated one-hour session during which the Sleep
Consultant provides feedback to the Client, based on their review and analysis of the
Pre-consultation Form, Sleep Log, and other relevant data. Catherine Patel will use this
session to develop and present a guided, personalised sleep plan designed to help
parents improve their child's sleep, while addressing the family's specific goals and
challenges.


“Data Protection and Privacy Policy” refers to the document provided to the Client for
information. It outlines how Client information is collected, used, stored, and protected
in accordance with applicable data protection laws. By submitting the Booking Form
and engaging in the provision of Services, the Client agrees to the collection and use of
their data solely for the purposes of providing sleep consultancy services. Client
information will never be shared with third parties without explicit consent.


“Invoice” refers to the document issued to the Client following the submission of the
Booking Form. It outlines the details of the selected Service Package, the associated
fees, and the payment terms. Payment of the invoice confirms the Client’s agreement
to these Terms and Conditions and secures their booking.


“Pre-consultation Form” refers to the document provided to the Client after the
booking process is complete. It collects detailed information about the child’s sleep
patterns, routines, any medical conditions, and any relevant family background. This information is essential for creating a tailored Sleep Plan that meets the specific needs
of the child and family. Completion and submission of the Pre-consultation Form is
required in advance of the Consultation.


“Services” means the work to be undertaken by LBS for the Client as described in the
Service Packages detailed in the Booking Form and chosen by the Client.


“Service Package” refers to the specific sleep plan selected by the Client, as outlined in
the Booking Form. Each package includes a predefined set of services tailored to
support the Client’s needs, such as Consultations, customised Sleep Plans, follow-up
support, and other resources. The details and inclusions of each Service Package are
clearly communicated to the Client prior to booking.


“Sleep Consultant” is a certified professional who provides non-medical advice,
guidance, and support to Clients seeking to improve their child’s sleep. Using evidence-
based research and techniques, a Sleep Consultant offers tailored solutions, education,
and resources to help Clients establish healthy sleep habits that are developmentally
and age-appropriate. The Sleep Consultant promotes informed decision-making by
helping Clients identify their sleep goals and select suitable sleep training methods that
align with their values and comfort levels, and by supporting them through the
implementation of the Sleep Plan.


“Sleep Log” refers to detailed records provided by the Client documenting the child’s
sleep patterns, including sleep and wake times, naps, night awakenings, and other
relevant observations. This is used by LBS to assess progress, identify patterns or
challenges, and inform any necessary adjustments to the personalised Sleep Plan.


“Sleep Plan” refers to a customised, step-by-step strategy developed by LBS based on
the specific needs, goals, and circumstances of the Client and their child. This is
informed by the assessment of information provided by the Client, including Pre-
consultation form, Sleep Logs, routines, and lifestyle factors. The Sleep Plan outlines
evidence-based techniques and actionable steps to establish healthy and
developmentally appropriate sleep habits for the child.


“Support Call” refers to a scheduled telephone or video call provided by LBS as part of
a Service Package or as an additional service post-Consultation. Support Calls scheduled
outside of the selected Service Package are subject to an additional fee, as detailed in
the Booking Form.

The Client acknowledges that:
 

Services
1. I have been given the opportunity to speak with a Sleep Consultant to ask questions
before booking the Service Package and am satisfied that my selection is appropriate for
my needs.


2. I have read and understand the Service Package, fees and duration of Consultation
Services that will be provided by LBS as set out in the Booking Form on the following
Terms and Conditions:


Payment and Fees
3. I agree to make full payment of the Invoice.


4. The Assessment shall not commence until full payment of the Invoice has been received
by LBS. No Consultations or Support Calls shall be scheduled until full payment of the
Invoice has been received by LBS.


5. I understand that an additional fee of £50 per Service will be incurred for each additional
child I wish to have support for. If the additional child has any special needs or
requirements, this may necessitate a full payment for the Service, which should be
discussed and agreed upon with LBS in advance.
Rescheduling, Cancellation and Termination


6. If I am unable to attend a scheduled Consultation, I can request for the Consultation to be
rescheduled provided I notify LBS of the cancellation at least 48 hours in advance. A
Consultation can be rescheduled by the Client a maximum of one time.


7. I accept that a re-booked Consultation must be scheduled within 30 days of the original
Consultation date and that the re-booked date is subject to the Sleep Consultant’s
availability.


8. I accept that if I fail to give at least 48 hours advance notice of a Consultation
cancellation, or do not attend any scheduled Consultation, I will lose that Consultation,
which will be considered cancelled by me. I accept that for any Consultations cancelled by
me, I will not receive a refund under any circumstances.


9. If I am unable to attend a scheduled Support Call, I can request for the Support Call to be
rescheduled provided I notify LBS of the cancellation at least 24 hours in advance. A
Support Call can be rescheduled by the Client a maximum of one time.


10. I accept that a re-booked Support Call must be scheduled within 7 days of the original
Support Call date and that the re-booked date is subject to the Sleep Consultant’s
availability.

11. I accept that if I fail to give at least 24 hours advance notice of a Support Call cancellation,
or do not attend any scheduled Support Call, I will lose that Support Call, which will be
considered cancelled by me. I accept that for any Support Calls cancelled by me, I will not
receive a refund under any circumstances.


12. If I cancel, or do not wish to continue with the Services after payment has been received
by LBS, I understand that I will not be entitled to any refund.


13. I understand that LBS reserves the discretion to suspend or withdraw the provision of
Services and may instead signpost to other interventions if appropriate. If LBS suspends
the provision of Services such suspension will last no longer than 2 months from the date
I am notified of suspension. After that date, support will resume, or LBS may decide to
terminate the provision of Services.


14. If LBS terminates the provision of Services, I will be entitled to a pro-rated refund for any
unused Support Calls. I agree that LBS will not owe me anything else, including time,
replacement Services or money.


Responsibilities of the Parent/Carer
15. I confirm that the information I provide to LBS and any of its Sleep Consultants will be
complete, true and accurate and that I will keep LBS up to date with any changes to
information previously provided.


16. I agree to disclose any medical conditions or relevant health information regarding my
baby/child to LBS. This information is crucial for ensuring that the analysis, suggestions,
and recommendations provided are appropriate and tailored to my child’s specific needs.


17. I understand that any changes made to my baby or child’s sleep, feeding or routine are
suggestions and I as the parent or legal guardian am responsible for choosing to
implement. I understand results are entirely dependent on the commitment from myself
as the caregiver to consistently follow the plan and that no guarantees can be given due
to the many factors which impact on sleep and behaviours.


18. I understand any information given is not intended to be a substitute for professional
medical advice, diagnosis, or treatment. I agree to seek the advice of a GP or other
qualified medical provider regarding medical treatment or conditions.


19. I agree to taking responsibility to follow safe sleeping practices in line with SIDS Guidance
- for more detailed information refer to The Lullaby Trust. If I choose to ignore this
guidance, I do so completely at my own risk and responsibility.


20. I accept and understand I should be in good physical and mental health, and I am capable
of following guidance offered by LBS as part of its services.

 

Scope of Services and Limitations
21. Suggestions offered are based on information shared at point of Consultation, Sleep Log
and follow up information. The Sleep Consultant will share their knowledge and
suggestions for the most appropriate course of action but cannot guarantee success.


22. I understand goals may not be achieved during the period of working together but that
LBS will provide a range of tools and suggestions to support me in working towards my
aims.
23. I understand my sleep Assessment and Sleep Plan is meant only for my family and may
not be shared with any third party.


24. To the fullest extent permitted by law, LBS disclaims any and all warranties, whether
statutory, express, or implied in relation to the Services provided.


25. As the parent or legal guardian, I agree that I will not hold LBS liable for any loss, damage,
injury, or other claims arising directly or indirectly from the Services provided, except
where liability cannot be excluded by law: (a) where loss or damage is caused by LBS’s
fraud or fraudulent misrepresentation, or (b) where death or personal injury is caused by
LBS’s negligence.


26. Nothing in these terms and conditions affect my statutory rights under the Consumer
Rights Act 2015, or any other applicable consumer protection legislation in England.


27. I acknowledge that I am voluntarily accepting responsibility for decisions to implement
the advice provided and do so entirely at my own risk and liability.


Support and Communication
28. I understand and accept that the Sleep Consultant may be unavailable due to personal
reasons or work-related appointments. The Sleep Consultant endeavours to answer all
enquiries within 24 hours (except on a Sunday), however during holiday periods,
evenings, and weekends there may be a delay in response. Evening appointments and
weekend support should be scheduled and agreed in advance.


29. I agree to only contact the Sleep Consultant between the hours of 9am – 9pm for follow-
up support via WhatsApp or email. The Sleep Consultant will always aim to reply to
messages within 24 hours of receipt. Should support be needed outside of these hours
then this needs to be pre-arranged and suitable for both parties.


Data Protection, Privacy and Confidentiality
30. I understand that LBS will need to collect certain personal data for me and my child for
the purposes of providing me with the Services. I have read and understood the Data 

Protection and Privacy Policy and consent to such data being collected, held, and
processed by LBS.


31. I agree that the Sleep Plan, Pre-consultation Form, Sleep Log and any other LBS
documents are confidential and belong to LBS and that they are provided to me for my
use only and I agree to keep it confidential and not to share it with other persons,
whether privately or by any public or private media platform or device.


General Provisions
32. My booking with LBS does not give rise to any rights under the Contracts (Rights of Third
Parties) Act 1999 to enforce any term of this Agreement.


33. The booking and these terms and conditions are governed by and shall be construed and
interpreted in accordance with English law and subject to the exclusive jurisdiction of the
courts of England.

Lullaby Baby Sleep reserves the right to modify these Terms and Conditions or any part of them
at any time. Any changes and/or clarifications will take effect immediately.
I accept responsibility and agree to the Terms and Conditions as provided prior to booking.
